OVERVIEW

Welcome to Nanref Home. Fernando Enrique del Amo Torres, a sole proprietor, operates this store under the name Nanref Home. In these Terms of Service, “Nanref Home,” “we,” “us,” and “our” refer to Fernando Enrique del Amo Torres, the legal seller and contracting party.

Nanref Home operates this store and website, including the related information, content, features, tools, products, and services offered through it (collectively, the “Services”). Nanref Home is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with the policies referenced in them (the “Terms”), describe your rights and responsibilities when you access or use the Services or place an order with us. Please read them carefully.

By accessing or using the Services, you agree to these Terms and our Privacy Policy, available at https://nanrefhome.com/policies/privacy-policy. If you do not agree, do not use the Services. Nothing in these Terms limits any consumer right or remedy that cannot lawfully be waived.

SECTION 1 — ACCESS AND ACCOUNTS

You must be at least the age of majority in your state of residence to make a purchase or create an account. A minor may use the Services only under the direct supervision of a parent or legal guardian who accepts these Terms on the minor’s behalf.

You may be asked to provide information such as your name, email address, billing information, payment information, and shipping address. You agree to provide information that is accurate, current, and complete and that you have the right to provide.

You are responsible for protecting your account credentials and for activity conducted through your account, except for activity resulting from a security failure for which you are not responsible. Please contact us promptly if you believe your account has been accessed without authorization. You may not sell, transfer, assign, or license your account to another person.

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to display and describe our products accurately. Colors, dimensions, textures, finishes, and other visual details may appear somewhat different depending on your device, screen settings, manufacturing variations, or the materials used in a particular production batch. Measurements described as approximate should be understood as reasonable estimates.

Product descriptions, photographs, specifications, prices, and availability may be updated when necessary. We may discontinue a product or reasonably limit purchase quantities, including when inventory is limited, an order appears intended for unauthorized resale, or a legal or shipping restriction applies.

You should read and follow all product instructions, warnings, care information, installation guidance, and age recommendations supplied with a product. Any material discrepancy, defect, damage, or incorrect item will be addressed under our Return and Refund Policy and applicable law.

Nothing in this section limits any express warranty, product description, statutory warranty, or consumer remedy that applies to your purchase.

SECTION 3 — THIRD-PARTY SUPPLIERS AND FULFILLMENT

We may use third-party manufacturers, suppliers, warehouses, fulfillment providers, and shipping carriers to source, store, package, or deliver products. In some cases, a supplier or fulfillment provider may ship a product directly to you. Its name, return location, or shipping origin may appear on a parcel, packing slip, or carrier record. Items in the same order may arrive in separate packages or at different times.

These arrangements do not change your purchase relationship with us. Nanref Home remains the seller responsible for your order and your primary point of contact for order support, cancellations, returns, refunds, damaged or defective products, and incorrect items. You do not need to contact a supplier or fulfillment provider to exercise your rights against Nanref Home.

Third-party providers may receive information reasonably necessary to perform their services, subject to our Privacy Policy. Because approved return locations may vary by product, do not send an item to the address shown on its original parcel unless we specifically authorize that return address.

SECTION 4 — ORDERS, CANCELLATIONS, RETURNS, AND REFUNDS

When you submit an order, you are offering to purchase the selected products. An automated order acknowledgment confirms that we received your order but does not necessarily mean that we have accepted it. We may decline or cancel an order for a legitimate reason, including product unavailability, a material pricing or description error, suspected fraud, payment authorization failure, purchase-quantity limits, or a legal or shipping restriction.

An order is accepted when we send confirmation of acceptance, begin fulfillment, or ship the order, whichever occurs first. If we decline or cancel an order after payment has been collected, we will issue a full refund of all amounts paid for the affected item or order to the original payment method.

Please review your order carefully before submitting it. You may request cancellation at any time before the order is fulfilled by contacting us at support@nanrefhome.com. Because orders may begin processing quickly, a cancellation is not effective until we confirm it. Once an order has been fulfilled or shipped, it cannot be canceled, but an eligible item may be returned after delivery.

Eligible returns may be requested within 30 days after delivery. Return eligibility, authorization requirements, return shipping, exceptions, final-sale items, refund timing, and other return conditions are governed by our Return and Refund Policy at https://nanrefhome.com/policies/refund-policy. A discounted or promotional price alone does not make an item final sale; only an item clearly identified as Final Sale before purchase is excluded on that basis. We do not process direct exchanges; when permitted by the Return and Refund Policy, you may return the original item and place a separate order.

These purchase and return provisions currently apply to orders shipped within the United States. Nothing in this section limits cancellation, refund, chargeback, warranty, or other rights available under applicable law.

SECTION 5 — PRICES, PAYMENT, AND BILLING

The price charged will be the price displayed at checkout when you place the order, subject to the correction of a clear pricing error as described in Section 13. Unless expressly stated otherwise, product prices do not include applicable taxes or separately disclosed shipping charges. All charges will be shown before you submit your order.

Prices, discounts, and promotions may change prospectively without notice. A promotion may have separate terms. If its specific terms conflict with these Terms, the promotion terms control for that promotion, except that a discounted or promotional item remains eligible for return unless it was clearly identified as Final Sale before purchase.

You agree to provide accurate and current purchase, billing, and payment information. You represent that you are authorized to use the selected payment method. Payment processing may be performed by Shopify or another authorized payment provider under that provider’s applicable terms and privacy practices.

SECTION 6 — SHIPPING, DELIVERY, DELAYS, AND RISK OF LOSS

Shipping and delivery dates are estimates unless we expressly identify a date as guaranteed. We and our fulfillment partners will make reasonable efforts to ship within the timeframe stated at checkout or in your order confirmation. If no shipping timeframe is stated, we will ship within 30 days after receiving a properly completed order, unless applicable law provides a different deadline.

If we learn that we cannot ship within the promised timeframe, we will notify you and offer you the choice to consent to the delay or cancel the affected item or order for a full refund. If you do not consent when consent is required, we will cancel the unshipped item or order and issue the full refund promptly and within the time required by law.

We are not responsible for a delay caused by a carrier, severe weather, natural disaster, labor disruption, governmental action, address problem, or another event outside our reasonable control, but we remain responsible for providing legally required notices, assistance, cancellation options, and refunds.

Risk of loss or damage remains with Nanref Home until the product is delivered to the shipping address or other delivery location you authorized, except where applicable law provides otherwise. For an order delivered in separate packages, risk of loss transfers separately for each product when that product is delivered. If an item arrives damaged, defective, or incorrect, or tracking states that it was delivered but you cannot locate it, contact us promptly so we can investigate and provide the assistance or remedy required by our Return and Refund Policy and applicable law.

SECTION 7 — INTELLECTUAL PROPERTY

The Services and their original content, including our text, graphics, photographs, videos, audio, page design, selection, arrangement, branding, and logos, are owned by or licensed to Nanref Home and are protected by applicable intellectual-property laws. Product content supplied by manufacturers, suppliers, Shopify, or other licensors remains the property of its respective owner.

We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Services for lawful personal and household purposes. Except as permitted by law or with prior written authorization from the relevant rights holder, you may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, transmit, sell, or commercially exploit protected material from the Services.

Nanref Home’s name, logo, designs, product names, service names, and slogans are trademarks or trade dress of Nanref Home or its licensors. Shopify’s name, logo, designs, product names, service names, and slogans are trademarks of Shopify. Other names and marks appearing through the Services belong to their respective owners. No license to use any trademark is granted except as expressly stated.

SECTION 8 — OPTIONAL THIRD-PARTY TOOLS

The Services may provide access to optional tools or features supplied by third parties. We may not control or monitor those tools, and their use may be subject to separate terms and privacy policies.

Your use of an optional third-party tool is voluntary. To the extent permitted by law, Nanref Home is not responsible for the independent operation, availability, or content of a third-party tool. This does not limit responsibility that applicable law imposes on us for our own conduct, representations, or selection of a provider.

New features and resources that we add to the Services will also be subject to these Terms unless different terms are clearly presented.

SECTION 9 — THIRD-PARTY LINKS AND TRANSACTIONS

The Services may contain links to websites, content, or services operated by third parties. A link does not necessarily mean that we endorse or control the third party. We are not responsible for evaluating every third-party website, and your use of an external site is subject to that site’s terms and privacy practices.

A purchase made directly on an unrelated third-party website is a transaction with that third party. However, products purchased from Nanref Home remain our responsibility as described in these Terms even when a third-party supplier or fulfillment provider sources or ships them. Questions or concerns about a Nanref Home order should be directed to Nanref Home.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

Nanref Home is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Nanref Home. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Nanref Home, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Nanref Home. Nothing in this section releases a claim or liability that applicable law does not permit to be released.

SECTION 11 — PRIVACY

Personal information we collect through the Services is handled in accordance with our Privacy Policy at https://nanrefhome.com/policies/privacy-policy.

Because Shopify hosts the Services, Shopify collects and processes certain personal information relating to your access to and use of the Services to provide and improve its services. Certain information may also be subject to Shopify’s privacy policy at https://www.shopify.com/legal/privacy/app-users.

Information submitted through the Services may be transmitted to Shopify and to service providers, suppliers, fulfillment partners, payment processors, and other partners that may be located outside your state or country. Our Privacy Policy explains how Nanref Home and its providers collect, use, disclose, and protect personal information and describes the rights available to you.

SECTION 12 — REVIEWS, FEEDBACK, AND USER CONTENT

If you voluntarily submit a review, photograph, comment, suggestion, idea, or other content (“Feedback”), you retain ownership of your Feedback but grant Nanref Home a nonexclusive, worldwide, royalty-free license to host, reproduce, adapt for formatting, publish, display, distribute, and use it as reasonably necessary to operate, improve, and promote the Services. This license lasts only as long as reasonably necessary for those purposes, subject to rights that cannot be revoked after authorized materials have already been produced or distributed.

You represent that you own or have permission to submit the Feedback, that it is accurate to the best of your knowledge, and that it does not violate another person’s intellectual-property, privacy, publicity, or other rights. You must disclose any compensation, free product, discount, or other material incentive received in connection with a review when required by law.

Feedback must not be unlawful, fraudulent, defamatory, threatening, abusive, obscene, malicious, or contain malware or deceptive links. You may not impersonate another person or misrepresent the origin of Feedback.

We may moderate or remove Feedback for a legitimate reason, including a violation of these Terms, but we will not suppress an honest review merely because it is negative.

SECTION 13 — ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, the Services may contain a typographical error, inaccuracy, or omission relating to product descriptions, prices, promotions, shipping charges, transit times, or availability. We may correct the information and update the Services.

If a material error affects an order you submitted, we will notify you when reasonably possible. We will not charge a higher corrected price without your consent. You may confirm the order using the corrected information or cancel the affected item or order for a full refund. We may also cancel and refund an order if the error makes fulfillment impracticable or unlawful.

SECTION 14 — PROHIBITED USES

You may use the Services only for lawful purposes. You may not:

  1. violate any applicable law or regulation;

  2. infringe or misappropriate our rights or another person’s intellectual-property, privacy, publicity, or other legal rights;

  3. submit false, fraudulent, defamatory, threatening, abusive, obscene, or materially misleading information;

  4. impersonate another person or misrepresent your identity or authority;

  5. transmit malware or other code intended to damage, interrupt, monitor, or gain unauthorized access to a system or data;

  6. send spam, phishing messages, chain letters, or unauthorized advertising;

  7. collect or track another person’s personal information without lawful authority;

  8. interfere with, bypass, or circumvent a security, authentication, rate-limiting, access-control, or robot-exclusion measure;

  9. scrape, copy, extract, sell, resell, or exploit a material portion of the Services without authorization; or

  10. use the Services in a manner that materially interferes with another person’s lawful use, may harm Nanref Home, Shopify, or another person, or may expose any of them to liability.

Automated access is permitted only when it complies with Section 15 and any technical instructions we make available. We may suspend or restrict access when reasonably necessary to investigate or stop a violation, protect users or systems, or comply with law.

SECTION 15 — AGENTS

15.1 This section applies if you use, permit, enable, or deploy an automated or semi-automated software service to access, use, or interact with the Services on your behalf (an “Agent”).

15.2 An Agent must identify itself and operate in accordance with this section. An Agent may not access or interact with the Services after we have specifically instructed it to stop.

15.3 We may use reasonable technical measures to manage whether and how Agents access or interact with the Services.

15.4 An Agent must:

  1. identify automated HTTP or HTTPS requests by including “Agent/[agent name]” in its user-agent string;

  2. not conceal or misrepresent that an interaction is automated, including by deceptively mimicking human behavior or circumventing a CAPTCHA;

  3. answer truthfully when asked whether an interaction is coming from a human or an automated system; and

  4. not bypass a measure designed to block, limit, modify, or control automated access.

SECTION 16 — SUSPENSION AND TERMINATION

You may stop using the Services at any time. We may suspend or terminate access to all or part of the Services if we reasonably believe you have materially violated these Terms, created a security or fraud risk, or used the Services unlawfully. When practical and lawful, we will provide notice or an opportunity to correct the issue.

Termination of website access does not cancel an accepted order, eliminate an accrued refund or warranty obligation, or relieve either party of payment or other obligations that arose before termination.

Provisions that by their nature should continue after termination—including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Governing Law, and accrued payment or refund obligations—will survive.

SECTION 17 — DISCLAIMER OF WARRANTIES

We use reasonable care in operating the Services, but we do not promise that the website, account features, or optional tools will always be uninterrupted, secure, available, or free from every technical error.

To the fullest extent permitted by law, the website and general informational content are provided “as is” and “as available,” and we disclaim implied warranties relating solely to the operation of the website. This disclaimer does not apply to an express representation or written warranty made by Nanref Home, a product description forming part of your purchase, our delivery and refund obligations, or any warranty or consumer right that cannot lawfully be disclaimed.

Products purchased through the Services remain subject to all express warranties included in their listing or packaging and all implied warranties and statutory protections that applicable law does not permit us to exclude.

Some jurisdictions do not allow certain warranty exclusions, so an exclusion in this section may not apply to you.

SECTION 18 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, neither party will be liable to the other for indirect, incidental, special, exemplary, punitive, or consequential damages that were not reasonably foreseeable when the applicable transaction or use of the Services occurred.

Except for the categories of liability listed below, Nanref Home’s total liability arising from a particular product or order will not exceed the amount you paid for the affected product or order. For a claim arising solely from use of the website and unrelated to a purchase, Nanref Home’s total liability will not exceed $100.

This limitation does not exclude or limit:

  1. payment, delivery, return, refund, repair, replacement, or other direct obligations relating to an order;

  2. direct losses caused by a breach of these Terms;

  3. liability for death or personal injury caused by negligence;

  4. product-liability claims;

  5. fraud, fraudulent misrepresentation, gross negligence, or willful misconduct;

  6. a violation of privacy, data-security, intellectual-property, or confidentiality rights to the extent liability cannot lawfully be limited; or

  7. any other liability, consumer right, statutory remedy, or category of damages that applicable law does not permit the parties to exclude or limit.

Nothing in these Terms requires you to waive a nonwaivable right or prevents you from seeking a remedy available under applicable law.

SECTION 19 — INDEMNIFICATION

You agree to indemnify Nanref Home against a third-party claim only to the extent the claim is caused by:

  1. your intentional unlawful misuse of the Services;

  2. Feedback you submitted that infringes or misappropriates the third party’s rights; or

  3. your material breach of these Terms.

This obligation does not apply to an ordinary consumer purchase or ordinary use of a product or the Services, and it does not apply to the extent a claim was caused by Nanref Home’s negligence, breach, unlawful conduct, or willful misconduct.

We will give you reasonably prompt notice of an indemnified claim. A delay in notice reduces your obligation only to the extent it materially prejudices your defense. You may control the defense using reasonably acceptable counsel, and we will reasonably cooperate. You may not settle a claim in a way that admits fault by, imposes a nonmonetary obligation on, or fails to fully release Nanref Home without our written consent, which will not be unreasonably withheld.

SECTION 20 — SEVERABILITY

If a provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the greatest extent permitted by law or, if that is not possible, severed. The remaining provisions will remain effective.

SECTION 21 — WAIVER AND ENTIRE AGREEMENT

A failure or delay in enforcing a provision of these Terms is not a waiver of the right to enforce it later.

These Terms and the policies expressly incorporated into them constitute the entire agreement between you and Nanref Home concerning the Services and supersede prior communications about the same subject. Specific product descriptions, written warranties, order confirmations, and promotion terms remain effective for the transactions to which they apply.

SECTION 22 — ASSIGNMENT

You may not assign or transfer your account or your material obligations under these Terms without our written consent.

We may assign these Terms in connection with a sale, merger, reorganization, or transfer of all or substantially all of the relevant business or assets, provided that the assignment does not reduce your accrued rights. When required by law, we will notify you of the assignment.

SECTION 23 — GOVERNING LAW AND VENUE

These Terms and any separate agreement under which Nanref Home provides the Services are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Except where applicable law permits or requires otherwise, any lawsuit arising from or relating to these Terms, the Services, or a purchase from Nanref Home must be brought exclusively in the state courts located in Miami-Dade County, Florida, or, if federal subject-matter jurisdiction exists, in the Miami Division of the United States District Court for the Southern District of Florida. You and Nanref Home consent to the personal jurisdiction and venue of those courts.

This section does not deprive a consumer of mandatory protections provided by the law of the consumer’s state of residence, prevent either party from bringing an eligible individual claim in small-claims court where applicable law permits, or restrict the right to report a concern to a government or consumer-protection agency.

SECTION 24 — HEADINGS

Headings are included for convenience only and do not affect the interpretation of these Terms.

SECTION 25 — CHANGES TO THESE TERMS

The current version of these Terms will be available on this page. We may update these Terms prospectively to reflect changes to the Services, our business practices, or applicable law.

When required by law, we will provide notice of a material change and state its effective date. A material change will not retroactively reduce rights that accrued under an order accepted before the change took effect unless the change is required by law. Your continued use of the Services after an updated version becomes effective constitutes acceptance of the updated Terms for future use and transactions.
